Can I apply them to non-wages paid?” You can use Form 1040 Line 20a or 20b in a tax year to apply amounts paid in an earlier year that have not been reported in the previous year's Form W-2. You or your employer might not have paid amounts from Form W-2. For example, an employee's wages are paid by the government to the employee for his or her services. On Form W-2 the taxpayer declares the total annual wages from the previous year (in boxes 30, 31, 32, 33 or 34) and pays an employer-paid tax withholding of this total annual wages from the wages reported in boxes 37, 38, 39 or 40 of Form 1040. You do not have to report on Form W-2 the amount for box 37, 38, 39 or 40 of Form W-2, because the amounts should have been paid to you. Use the Form 1040 Line 20a or 20b instructions to apply the tax paid from the Form W-2 for the later years that you do not have to report on the Form W-2. The amounts in box 37 (or 38 or 39) might not have been paid to you because the taxpayer withheld the amount from both the Forms W-2 for the two years and then gave it to you. For example, the amount withheld from Form W-2 for box 37 might no longer be available. This was not reported on the Form W-2. The amounts withheld on Form 1040 for box 38 or 39 would be available. It will be a mistake to file Form 1040 Line 20a or line 20b after you filed Form 1040. If you file Form 1040 Line 20a or line 20b and file Form 1040C to correct past tax matters, you might be considered a new taxpayer. To make this determination, your return and Schedule A (Form 1040) are considered to be filed with a new schedule.
